A Search Warrant Has Been Executed. Immediate Steps.
The execution of a search warrant at your home or business premises is highly disruptive, intensely stressful, and represents a significant escalation in an investigation. The actions taken in the immediate aftermath are critical to protecting your position.
Immediate Actions
- Remain Calm and Cooperative: Do not obstruct the officers. Obstruction is a separate criminal offence. Be polite but firm about your rights.
- Request to See the Warrant: You are entitled to see the warrant and the accompanying schedule. Read it carefully. It dictates the scope of the search, the specific premises that can be searched, and the types of materials that can be seized.
- Contact Legal Counsel Immediately: Inform the lead officer that you wish to contact your legal representative. While they do not have to delay the search until your lawyer arrives, establishing contact is essential.
- Do Not Answer Questions: The execution of a search warrant is not an interview. Do not attempt to explain documents or items. State clearly that you will not answer questions without legal advice.
Your Rights During a Search
Officers must operate strictly within the parameters set out in the warrant. They are generally not permitted to seize material subject to Legal Professional Privilege (communications between you and your lawyers).
Digital Evidence and Devices
It is almost certain that digital devices (computers, smartphones, servers) will be targeted. Officers have powers to compel you to provide passwords or encryption keys under section 49 of the Regulation of Investigatory Powers Act (RIPA). However, failure to comply is a separate offence. You must seek immediate legal advice on whether to provide access codes.
Post-Search Strategy
Following a search, the priority shifts to damage control and strategy formulation:
- Inventory Assessment: Analyzing the list of seized items to understand the investigators' focus.
- Challenging the Warrant: If the warrant was obtained or executed unlawfully, it may be possible to challenge it via Judicial Review and demand the return of seized property.
